1. Terms
1.1 The terms 'Erskine', 'Erskine Outdoor' and ‘us’ refers to the business Erskine Outdoor which owns and operates the websites accessed via the domain name 'http://erskineoutdoor.com' including all subdomains and all domains which redirect to that website (“the website”). Any reference to 'Erskine' and 'Erskine Outdoor' refers to the business, the websites and all content on the websites.
1.2 The terms ‘the customer’ and ‘you’ are used interchangeably and throughout this document to refer to both individuals or companies placing or who have placed orders with us and those using the website in any manner, i.e. potential customers or browsing shoppers.
2. Acceptance of Policies
2.1 Erskine Outdoor offers the website including all information, products and services available from the website to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here and in our Privacy Policy. By visiting our site and/or purchasing something from us, you agree to be bound by the following Terms and Conditions, including those additional Terms and Conditions and policies referenced herein.
2.2 We reserve the right, at our sole discretion, to update, change or replace any part of these Terms and Conditions by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
3. Website Images
3.1 We make every effort to ensure that images displayed on our website are as accurate as possible but cannot guarantee an exact match to the product as displayed on your screen.
3.2 Product images, including names, descriptions and packaging, may occasionally differ to the actual product received due to changes in packaging and/or availability.
4. Product Specification
4.1 All product information and technical specifications contained in Erskine Outdoor are for guidance only and rely on information provided by various suppliers. We take no responsibility for inadvertent errors or omissions.
4.2 Erskine Outdoor specifically disclaims all warranties, whether expressed or implied, including but not limited to fitness for a particular purpose. No oral advice or written information given by Erskine Outdoor shall create a warranty.
5. Pricing
5.1 All prices for products displayed on the website do not include shipping costs or any applicable customs duties or other charges. These will be charged over and above the specified product prices unless otherwise expressly agreed.
5.2 Prices and offers are subject to change without prior notice. Products displayed on the website will reflect the prices displayed at the moment of purchase.
5.3 Errors in pricing or availability will be corrected where discovered, and Erskine Outdoor reserves the right to revoke any stated offer and to correct any errors, inaccuracies or omissions including after an order has been submitted and whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Erskine Outdoor will issue a refund to your credit card account for the amount charged. Individual bank policies will dictate when this amount is credited to your account.
5.4 Sales prices, discount offers or promo codes advertised on the website are reference to selected products only, as shown on individual product pages. All sales and offers are subject to availability, while stocks last. Prices are correct at time of sending. Erskine Outdoor reserves the right to update or withdraw any offer at any time and without notice. Not valid on previous purchases or when combined with any other promotional offers.
6. VAT and Customs Charges
6.1 Currently Erskine Outdoor is not registered for VAT in the UK and therefore all prices do not apply VAT. All prices shown exclude all applicable import duties or other charges for orders placed from outside the UK. If you place an order from outside the UK, it is your responsibility to cover any international customs charges or import tax.
7. Currencies
7.1 All prices are shown in GBP and all transactions are processed in GBP. Any currency conversion shown is an estimate only, and the actual charge will be made in GBP. The value shown in a given currency other than GBP may differ from the amount charged. The amount charged will depend on the chosen payment method's rate of conversion and may include additional charges.
8. Special Offers
8.1 Erskine Outdoor reserves the right to withdraw or modify special offers at any time. All products are sold on a first come first served basis and no further discounts may be applied. When free shipping is offered, we reserve the right to send via the most economical service.
8.2 Promotional codes and gift cards are debited at the time of your order. Digital coupons are automatically redeemed if applicable to your purchase. Coupons cannot be replaced if they are lost, stolen, deleted, or if you cancel or return your purchase. Refunds will not be issued if the value of the coupon exceeds the value of your purchase.
9. Purchase Agreements
9.1 The products displayed on the website constitute a non-binding product catalogue. Our product offerings on the website are non-binding and do not constitute an offer to conclude a purchase agreement.
9.2 By placing an order via the website, you make a binding offer to purchase the relevant products and to conclude a purchase agreement ("Agreement"). By placing an order you accept these Terms and Conditions and the Privacy Policy.
9.3 We will send you an Order Confirmation email once you have placed your order. However, this does not constitute acceptance of your order; in general an Agreement is deemed accepted and concluded once the items have been dispatched, subject to terms set out in third party terms to which we may be bound such as those of Apple Pay. As such:
9.4 We reserve the right to reject any order placed on the website and/or to limit quantities on any order without giving any reason. If we reject your order, we will attempt to notify you using the email address that you provided with the order. Your credit or debit card will be immediately refunded if we reject an order.
9.5 All products available on our website are subject to availability and are subject to change without notice. If the product is unavailable after ordering, we will inform you immediately by email or telephone. Your order will be cancelled and refunded automatically if we are unable to contact you.
10. Delivery
Estimated delivery times:
10.1 Any date of dispatch or delivery time is approximate only. Standard delivery times are 3-5 days after the order is placed. Delivery is to UK mainland addresses only. Erskine Outdoor will aim to dispatch orders for delivery to you in the time frame stated in the order confirmation and using your selected delivery method.
10.2 Delivery times do not include order processing times, which are on average 1-2 working days but may take longer.
10.3 Please allow additional time during busier period such as before Christmas and bank holidays. Delivery to more remote areas of the UK or abroad, may take slightly longer.
10.4 We reserve the right to deliver products within one order in separate parcels and separate deliveries, and will incur any additional costs of doing so.
Delays
10.5 In circumstances when we cannot deliver within the specified time frame (and where the cause of delay is not covered under clause 10.6 below) we will alert you as soon as possible. We will attempt to arrange a new delivery date.
10.6 We cannot take responsibility for delays caused by circumstances outside our control, e.g. delays caused by our delivery partners. Should they cause an unreasonable delay, we will work with delivery partners and others as necessary to try and complete delivery to you, or we will contact you to discuss options. However, Erskine Outdoor cannot be held responsible for the consequences of delayed delivery.
10.7 In the rare event that your order never arrives, you must notify us by email or using our Contact Us form on the website within 30 calendar days from the shipping confirmation email.
Damage
10.8 You must check the parcel for damage before accepting delivery, including where possible all packaging and products inside.
10.9 Do not accept a parcel showing major damage but instead reject delivery, note such damage with the courier, and notify us immediately of your action. Where possible please take photographic evidence of the major damage.
10.10 If you choose to accept a damaged parcel, you must note any visible damage on the packaging of the goods on the delivery receipt before signing, and take photographic evidence. You must then notify us immediately with a copy of the signed receipt if the goods inside or gift packaging is damaged. In the event you seek to return your item and/or seek a refund, we will require all such evidence.
10.11 Failure to comply with any of the above may affect your refund rights.
10.12 If no claim of damage has been notified to us within 3 days after deemed delivery of the package, we will not be able to consider a claim for a return or refund or any compensation.
10.13 For all delivery options, if the package is delivered to your safe place, mailbox or an approved person such as a flatmate or neighbour, then delivery will be deemed completed and we will not take any action in relation to a claim of damaged goods without photographic evidence and within the timeframes specified.
Delivery address
10.14 The customer is solely responsible for the accuracy of the postal address communicated. Please review your order confirmation carefully and notify us immediately if the address needs to be amended, prior to dispatch. We cannot guarantee any amendments after ordering. If a shipping address is invalid or not recognised, we will try and contact you by email or phone to update your address or where necessary we may cancel the order and process a refund.
11. Cancellation and returns
11.1 You are entitled to cancel the Agreement in accordance with applicable UK consumer laws.
11.2 Please contact us by email at hello@erskineoutdoor.com with your Order reference and details if you wish to amend or cancel your order immediately after the order has been processed.
11.3 If, after we have accepted your order, you wish to cancel the Agreement, you must do so in writing within 14 days from the day after you receive the goods. You can do this by emailing us at hello@erskineoutdoor.com or completing the Returns form on the ‘Delivery and Returns’ page of the website. You must provide all relevant information including name, date of order, invoice or order reference number, delivery address, reason for return and ideally photographic evidence if you are returning on the basis of damage or fault.
11.4 You must return the goods, which includes all items and packaging, to us at your own cost and risk (unless the item is faulty, in which case see section 12 below). You must return all relevant items in cancelled orders within 14 days from the date you requested to cancel the Agreement. When returning the package, you must include either the proof of purchase or some form of identification so we can match your package to the cancellation request.
11.5 Returned items are the customer’s responsibility until they reach us, including ensuring that the product, including all packaging and gift packaging, is securely packed to avoid damage on its return journey, and to retain proof of postage as we take no responsibility or liability for returned items that are not received by us.
11.6 We will check the package and goods upon receipt to assess their condition. If items have been damaged, used, or otherwise are not in ‘as new’ condition, we reserve the right to refuse a refund on this basis. For faulty goods, see section 12 below.
12. Faulty goods
12.1 In the event of defects in the products, the statutory provisions shall apply. We are under a legal duty to supply products that are in conformity with our Agreement.
12.2 If the items you ordered do not reach you in good condition (except where damage is caused by delivery, in which case see section 10 above), they are faulty, or are significantly different to as advertised, please contact us to arrange a replacement or return. We must be notified of damaged or faulty goods within 5 days of receipt (where damage is caused by delivery or third parties, see clause 10.12 above).
12.3 We will aim to acknowledge your complaint within 5 days and we will keep you informed about progress.
12.4 Erskine Outdoor will only credit you for the items that have been damaged or are faulty upon safe return of the goods to us. Erskine Outdoor will accept returns and give full refunds only in circumstances where the products have not been tampered with, damaged or 'used' in any way. Your payment will be refunded within 14 days of the agreement to refund.
12.5 Where you are returning items because they are faulty, not as described, or they do not do what they are supposed to do, where necessary you may need to describe your issue with the product for us to consider.
13. Refunds
13.1 If your items are faulty, you will receive a full refund. We will contact you about refunding the costs of returning items (see section 12 above).
13.2 If you decide to cancel the Agreement and items are not damaged, used and are in ‘as new’ conditions, you will receive a full refund of the amount paid under the Agreement.
14. Further liability
14.1 We shall have no liability for loss, damage or costs in relation to our Agreement or sales of our products that is attributed to your own fault, third party fault, or other events outside our control or our supplier’s control where they have taken reasonable care.
14.2 We do not accept liability to you or anyone else in relation to the advertisement or sale of our products, for any business-related loss, damage, or costs such as lost data or business interruption.
14.3 Such limited or excluded liability extends to any owners, affiliates or representatives.
15. Data Protection
15.1 Your submission of personal information to us is governed by our Privacy Policy. Please read our Privacy Policy accessible from the footer of the website for further details. Erskine Outdoor conforms to the UK Data Protection Act. Any information you provide is treated in strict confidence and is stored in a secure location. Customer details will not be disclosed in any way to any persons outwith Erskine Outdoor, unless required to do so to process the order or in order for us to comply with the law. 16. Termination
16.1 Erskine Outdoor reserves the right to abort access of our internet services if your behaviour is found to be discordant with these terms and conditions at any time.
17. Intellectual Property
17.1 No permission is given by Erskine Outdoor in respect of the reproduction or use for injurious or commercial purposes of any brand names, product names, designs and any other material shown on the Erskine Outdoor website or affiliated websites or sales platforms in which intellectual property rights subsist. You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of the website shall remain at all times the property of Erskine Outdoor. You are not permitted to use this material except where expressly authorised by us. You acknowledge and agree that the material and content contained within the website is made available for your personal non-commercial use only. Any other use of material and content of the website is strictly prohibited. You agree not to (and agree not to assist or facilitate and third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content. ALL RIGHTS RESERVED.
17.2 You are not entitled to resell any of our products delivered to you except with our express written permission.
18. Applicable Law
18.1 These Terms and Conditions are governed by the law of England & Wales. Any Agreement is between you and us only. No other person shall have any rights to enforce any of its terms.
